FRE-L attorneys frequently act as fiduciaries for people in need. That could mean being someone’s Guardian, Conservator, Trustee or Durable Power of Attorney. Some of the people we help have more functional ability than others. You want to foster independence whenever possible but it can be very hard–as fiduciaries, we have to account to Medicaid, Social Security, the courts and/or other family members. I recently connected with an outfit that could make this “independence” problem a little easier in specific cases. It is called TrueLink and it sets up Visa debit cards for people with specific limitations as to what services can be paid for and how much can be spent. I’m working with it now for a client and am optimistic about how the freedom and autonomy to make every day purchases will balance with my need to protect my client and conserve finances. It might also be a good solution for seniors who have been financially exploited by individuals and telephone scammers. Check it out!
